A considerable volume of court cases involve “small claims”, that is, claims of $15,000 or less, excluding interest (art. 536 CCP). These cases are heard by the Small Claims Division of the Court of Québec.

Before this division, you must represent yourself: a lawyer cannot argue your case for you, except in the rare cases where the court allows it because the matter raises a complex question of law (art. 542 CCP). The law does, however, expressly allow you to consult a lawyer to prepare your case, and it is very much in your interest to do so. A lack of familiarity with the rules of evidence or an incomplete file can jeopardize your chances of success, and can also irritate the court and the opposing party.

In practical terms, we can:

  • meet with you in a consultation to assess your case and advise you on your rights;
  • help you draft your claim (or your defence) and organize your exhibits;
  • prepare you for the hearing: how to present your version of the facts, the evidence to bring, witnesses and questions to expect.

Please note: since November 3, 2025, in the judicial districts of Gatineau and Pontiac, contested cases of $5,000 or less are subject to mandatory mediation, followed by arbitration if no agreement is reached. William Desrochers himself acts as an accredited small claims mediator; when he is the mediator in a case, he remains neutral and advises neither party.
